The Holidays Act
The Holidays Act 2003 came into force in 1st April 2004 and was further enhanced by the amendments in 2004. It sets out the minimum legal entitlements for:
  • Annual holidays
  • Public holidays
  • Sick leave
  • Bereavement leave

The Act replaces the Holidays Act 1981 and applies to all employees whether full time, part-time or casual. You will need to review your policies and procedures including employment agreements to ensure they comply with this legislation. The law required that you had amended employment agreements before 1st April 2005.

Employment agreements cannot specify that a rate of pay includes allowance for time and a half.
All agreements must specify the new provisions of sick and bereavement leave even if current clauses provide for a better award than in the Act. Failure to do so could result in additional leave entitlements that were not intended.
