Employment Agreement guide

The Position and the Duties
In every employment agreement, it is mandatory to include a Position clause and a Duties clause. The other four clauses - reporting, objectives, reviews, and secondment - do not need to appear in the agreement, but the employer may choose to include them if applicable.

Nature and Term of the Agreement
Including a description of the type of agreement is voluntary, but is recommended to ensure that both parties understand the arrangement into which they are entering. As well, the type of agreement defines an employee's rights and entitlements when it comes to pay and holidays. It is a good suggestion to ensure your understanding of your employment relationship, and affect that relationship in the agreement.

The Place of Work
All employment agreements are required to identify the place of work. When offering or accepting an agreement it is important to be clear about where the employee can be required to work, as issues such as travel time or availability of public transport can affect the employee’s ability to undertake the work. Once a place of work has been established any change should be made after consultation and discussion.

Fixed Place of Work
The parties agree that the Employee shall perform their duties at [insert location of Employer's premises].
Several Locations
The parties agree that the Employee shall perform their duties at any of the following locations [insert locations or types of locations], as directed from time to time by the Employer.
Flexible Location
The parties agree that the Employee shall perform their duties at [insert primary location], and at any other reasonable location to which they may be directed from time to time by the Employer.
